Terms of Use

1. Introduction

These Terms of Use (the “Terms”) govern your use of MANUL, a music notation editor (the “App”), and the website at manulscore.com (the “Site”), both provided by Atsushi Mori (森 篤史; “we”, “us”). The App and Site together are the “Service”.

By using the Service, you agree to these Terms.

2. Using the Service

• Anyone may use the Service if they comply with these Terms.
• You do not need to create or delete a user account to use the Service. See the Privacy Policy for newsletter subscriptions and unsubscribing.
• If you are under the age of majority, please use the Service with the consent of a parent or legal guardian.
• You are responsible for the device, internet connection, and related costs needed to use the App.

3. Your Scores

• You retain all rights in the scores and score content you create with the App. We make no claim to them.
• We do not collect score content or file names. See our Privacy Policy for details.
• You are responsible for complying with applicable law and for respecting third-party rights, including when entering, reproducing, or distributing existing music.

4. Feedback

We may use comments, requests, and bug reports you send us (“Feedback”) to improve the Service. We are not required to pay for Feedback, keep it confidential, or credit you for it.

5. Intellectual Property

Rights in the Service, including its software, design, and trademarks, belong to us or their respective owners. These Terms do not transfer those rights to you.

The App includes open-source software and sound assets that are subject to their own license terms. You can find those terms in the App under Settings → App Information → Software Licenses.

6. Prohibited Conduct

You may not:

• violate any law or public order and morals;
• infringe our rights or the rights of others;
• interfere with the operation of the Service, or attempt unauthorized access;
• reverse engineer, decompile, or disassemble the App except where applicable law or a license for software included in the App permits it; or
• submit the Site’s subscription form automatically or in bulk, or subscribe another person’s email address without their permission.

Despite the preceding restriction, you may modify, repackage, and re-sign the App for your own use in order to replace LGPL-licensed software included in the App. You may also reverse engineer, decompile, or disassemble the App to the extent needed to debug that modification. This permission is limited to your own use.

7. Third-Party Services

The Service may link to services provided by others, such as the feedback form or the app store. Their terms apply to your use of those services. We are not responsible for their content, availability, or your use of them.

8. Changes, Suspension, and Discontinuation

We may change, suspend, or discontinue all or part of the Service for maintenance, failures, natural disasters, or other reasons. Where practical, we will give advance notice of significant changes.

9. Disclaimers and Limitation of Liability

The Service is provided as is. We do not guarantee that it will meet your needs, provide any particular functionality, accuracy, or usefulness, or be available without interruption.

We do not provide a service to store your data on our servers or recover it for you individually. Please keep your own backup copies of important data.

To the extent permitted by law, if our ordinary negligence causes you loss, our liability is limited to ordinary, direct damages. This limit does not apply to intentional misconduct or gross negligence.

10. Personal Information

We handle information collected through the Service in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms when the law or the Service changes. We will post the updated Terms and their effective date on the Site or give notice by another appropriate method. For changes that materially affect users, we will give notice with reasonable advance notice.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute relating to the Service will be subject to the exclusive jurisdiction of the court with jurisdiction over our place of business as the court of first instance.

These Terms are available in Japanese and English. If the versions differ, the Japanese version prevails.
